Context: The Supreme Court of India, has ordered the release of a man sentenced to 20 years in jail for raping a minor girl whom he later married in 2014.

  • The court invoked its powers under Article 142 of the Constitution due to the peculiar circumstances of the case, despite previously upholding the conviction twice.
  • Judgement was delivered in response to curative petition which is the last recourse open to a petitioner after the review petition is dismissed.

 

Article 142 of the Constitution of India gives the Supreme Court the power to pass any decree or make any order to ensure complete justice in any matter pending before it

Any decree so passed or order so made shall be enforceable throughout the territory of India
