Challenges of regulating AI

  • Velocity of change: To keep the corporate AI race from becoming reckless requires the establishment and development of rules and the enforcement of legal guardrails. Dealing with the velocity of AI-driven change, however, can outstrip the federal government’s existing expertise and authority. 
  • What to regulate: Because AI is a multi-faceted capability, “one-size-fits all” regulation will over-regulate in some instances and under-regulate in others. The use of AI in a video game, for instance, has a different effect—and should be treated differently—from AI that could threaten the security of critical infrastructure or endanger human beings. AI regulation, thus, must be risk-based and targeted.

  • The introduction of e-way bill coupled with the crackdown on fake invoicing has helped in bringing in a substantial portion of GST revenues, which were either being evaded or under-reported, in order.
  • Over 53 lakh taxpayers and 67,000 transporters are enrolled on the e-way portal, generating, on average, 7.81 crore e-way bills per month. Since the launch of the system, a total of 292 crore e-way bills have been generated of which 42 per cent are for the inter-state transport of goods.
  • GST has eliminated the tax arbitrage that existed among the states under the CST/VAT regime.
  • Increase in logistic supply chain: With no such arbitrage under the IGST and with the e-way bills, the logistics supply chain efficiencies have increased manifold.

Various issues with respect to goods and services tax (GST) regime

  • The breakdown of trust and cooperative federalism between states and the Union government:
  • It turned out to be prescient as GST failed to live up to its economic promises and states’ revenues were protected through this guarantee, despite Finance’s attempt to wriggle out of this commitment during the pandemic under the alibi of an “act of God”.
  • The Union government’s proclivity to levy and appropriate cess revenues for itself without sharing them with the states has lent credence to the wisdom of guaranteed compensation for states.
  • This guarantee is now set to expire..
  • The recent Supreme Court’s judgment highlighting that the GST Council’s recommendations are not binding on the states:
  • The SC recently observed that it is in the national interest to have both cooperative and competitive federalism, and hence, the GST Council’s decisions are not binding on the states.
  • This means that states had and continue to have the right to either comply fully with the Council’s recommendations or modify them as they deem necessary.
  • This has opened the window for states to override the fundamental GST premise of a “one nation one tax”.
  • If pushed to a corner, states may now use the SC ruling as a shield.
  • Expiry of the revenue guarantee that protected states’ revenues 
  • GST is too precariously perched to yank away the compensation guarantee for states.
  • the Union government is not desirous of extending the compensation guarantee.
  • Difficulty in tax administration:
  • Goes against the canons of taxation.
  • A modern tax system should be fair, uncomplicated, transparent and easy to administer.
  • It must yield revenues sufficient to cover the cost of government services and public goods.
  • Lack of clarity on many rules is also leading to various litigation and different interpretations (of the same laws) by Advanced Ruling Authorities in different states.
  • Complicated taxation structure:
  • A World Bank study published in May 2018 said that the Indian GST rate was the second highest among the 115 countries with a national value-added tax.
  • It was also the most complicated, with five main tax rates, several exemptions, a cess and a special rate for gold.
  • The multilateral lender said that only five countries had four or more non-zero tax rates—India, Italy, Pakistan, Luxembourg and Ghana.
  • Falling revenue amid disruptions caused by the Covid-19 pandemic has continuously delayed the reform, leaving a large number of items in high tax slabs.
  • High compliance costs:are also arising because the prevalence of multiple tax rates implies a need to classify inputs and outputs based on the applicable tax rate. Along with the need to apply the correct rate, firms are required to match invoices between their outputs and inputs to be eligible for full input tax credit, which increases compliance costs further.
  • GST Council meetings: the meetings of the GST Council are not as frequent as they were earlier, if the recent incidents are anything to go by, and it often end up with disagreement, fight and strong letters and statements. States have also accused the Centre of cornering a substantial portion of tax in forms of cess.
  • There has been lack of coordination between the Department of Revenue, the Central Board of Indirect Taxes and Customs and the GST Network.

Way Forward

  • The first target should be to move to at least a three-rate structure, a lower rate for essential goods, a relatively high rate for luxury goods, and a standard rate for the majority of goods and services.
  • The next step would be simplifying the tax returns process.
  • The scope for lowering the GST rate is umbilically linked to direct tax reform.
  • Commence taxation of petroleum crude, high-speed diesel, petrol, natural gas and aviation turbine fuel and similarly, alcohol meant for human consumption;
  • Inclusion of other levies such as electricity duty, stamp duty, etc;
  • Clarifying taxation of online gaming activities, transactions involving cryptocurrency, etc.
  • A better way to make a tax system more just is by lowering regressive indirect tax rates while widening the base for progressive direct taxeson income and corporate profits.
  • The government needs to establishGST Tribunals to reduce litigation timelines and the pressure on courts.
  • The state authorities for Advance Ruling should ideally also have an independent jurist member, apart from a representative from the tax department.
  • Emulating the best practices. The GST in New Zealand, widely regarded as the most efficient in the world, has a single standard rate of 12.5 percent across all industry groups.
  • The Fifteenth finance commission, in its latest report, has addressed many issues including large shortfall in collections as compared to original forecast, high volatility in collections, accumulation of large integrated GST credit, glitches in invoice and input tax matching, and delay in refunds.
  • The Commission also observed that the continuing dependence of states on compensation from the central government for making up for the shortfall in revenue is a concern.
  • While at the same time it suggested that the structural implications of GST for low consumption states need to be considered.

Conclusion

While the GST’s journey has given its stakeholders some causes to celebrate, it has also given moments of worry. But then, no transformation of the scale and complexity can be achieved without its share of hiccups and challenges. The process of evolution will take a few years more for the mammoth structural change to stabilize. The four-year journey of GST has been a roller-coaster ride for all stakeholders with equitable share of hits, misses and expectations. A work-in-progress in its transformational journey, GST suffers from several shortcomings which need to be resolved quickly, but its journey to ‘Good & Simple Tax’ is still quite long.

India’s efforts towards quantum computing

  • India is getting there slowly but steadily. In February 2022, a joint team of the DRDO and IIT-Delhi successfully demonstrated a QKD link between two cities in UP — Prayagraj and Vindhyachal.
  • In 2019,the Centre declared quantum technology a “mission of national importance”.
  • The Union Budget 2020-21 had proposed to spend Rs 8,000 croreon the newly launched National Mission on Quantum Technologies and Applications.
  • The Army has collaborated with industry and academia to build secure communications and cryptography applications.
  • In 2018, the Department of Science & Technology unveiled a programme called Quantum-Enabled Science & Technology (QuEST)and committed to investing Rs. 80 crore over the next three years to accelerate research.
  • In December 2021, the Indian Army, with support from the National Security Council Secretariat (NSCS) established the Quantum Lab at Military College of Telecommunication Engineering, Mhow to spearhead research and training in this key developing field.
  • In 2021, Government also inaugurated C-DOT’s Quantum Communication Laband unveiled the indigenously developed Quantum Key Distribution (QKD) solution.

Way forward

  • Both private funding and philanthropic funding should be attracted towards quantum computing. For example, Funds can be used to attract and retain high quality manpower and to build international networks.
  • Connections with Indian industry from the start would help quantum technologies to become commercially successful.
  • Investing manpower and retaining them as quality human resource is very mobile.
  • Participate in development of global standards and requirements for quantum computers.
  • Procurement from other nations:India must consider procuring the United States National Security Agency’s (NSA) Suite B Cryptography Quantum-Resistant Suite as its official encryption mechanism.
  • Emulating cryptographic standards: the Indian defence establishment can consider emulating the cryptographic standards set by the US’s National Institute of Standards and Technology (NIST) which has developed a series of encryption tools to handle quantum computer attacks.
  • Develop quantum-resistant systems: India should start implementing and developing capabilities in quantum-resistant communications, specifically for critical strategic sectors.
  • Funding: government can fund and encourage existing open-source projectsrelated to post-quantum cryptography.
  • Participating in the global initiative:India can participate in the Open Quantum Safe project — a global initiative started in 2016 for prototyping and integrating quantum-resistant cryptographic algorithms.
  • Prioritising QKDs over long distances, especially connecting military outposts for sensitive communications, can be prioritised to ensure secure communications whilst protecting key intelligence from potential quantum cyberattacks.
  • Diplomatic partnerships with other “techno-democracies” — countries with top technology sectors, advanced economies, and a commitment to liberal democracy — can help India pool resources and mitigate emerging quantum cyber threats.

Nuclear fusion is the process by which two light atomic nuclei combine to form a single heavier one while releasing massive amounts of energy. It is the opposite of nuclear fission, where heavy atoms are split apart. Nuclear fusion is described as the “holy grail” of energy production. It is the process that powers the Sun and other stars. Fusion reactions take place in a state of matter called plasma — a hot, charged gas made of positive ions and free-moving electrons with unique properties distinct from solids, liquids, or gases.

Japan has unveiled the world’s largest operational experimental nuclear fusion reactor. This colossal machine, dubbed JT-60SA, is housed in a hangar north of Tokyo in Naka, and represents a pivotal moment in the quest for clean and limitless power.

 Q7. You are hailing from a remote village. You are the only person who is pursuing a degree in your community. You have had access to education and modern values. You want every child in your village to have a good education. During holidays you visit your village and teach the children. In one such instance, you have come to know that one of the girls whom you used to teach is getting married. She is 17 and is about to complete her 12th standard. Child marriages like these were common within your community in the past but these have largely reduced now. You want to eliminate such practices. You have come to know that the person she is getting married to is your cousin. You talk to him about the importance of her education and the ills of child marriage. He seems to ignore your advice but promises that she will be allowed to continue her education and he is even ready to fund it. The girl’s parents have convinced her to accept the marriage as they can’t afford to educate her any further. You speak to both parties again but they are not ready to call off the marriage or wait for another year until she turns 18. Your mother scolds you for interfering in their family matters and says that nothing much is going to happen in a year. She warns that any further attempts would lead to fights within the family and even within the community. If that happens you will not be allowed to interact within the community and teach them further.

Introduction

Children are innocent and not rational being. They grow at the pace of biological maturation and in the way what is exposed to them. Their growth depends on environment, parents, facilities like books/schools/outside exposure, foods etc.

In initial years their mind and body is fast changing. Hence, it takes time to grow as mentally stable, physically capable to sustain as a part of society.

After marriage one has to take bigger roles and wider decisions about family which a child can’t sustain economically and psychologically.

Options available

  • Option 1: To let the marriage happen as the girl will be 18 in one year

Merits: I can continue to teach other children and since I’m assured, she will be educated further, marriage should not become a hindrance.

Demerits: One incident will lead to several more in the community. More children will be dragged for such marriages. It will create social pressure and also avenues for parents who think girl child as burden.

  • Option 2: Call the authorities to stop the marriage

Merits: This will act as a deterrence to others and will lead to empowerment of other women and girl children in the community.  Instead of one degree holder, there will be many.

Demerits: I may be ostracized in the family and community. But that will not stop me from doing the right thing.

  1. Why people still practice child marriage? Ethical issues
  • The present situation is mainly due to conflict between the general laws and traditional customs of communities with respect to marriage.
  • According to the Prohibition of Child Marriage Act, 2006 marrying a girl child at an age of less than 18 is prohibited. But in some societies, like discussed in present case, tradition of child marriage is prevalent.
  • This dilemma for the community is always there. However, they should be made to understand traditional values like this may be detrimental to their own community.

 

Physically also a marriage have a toll on both boy and girl and life becomes more tiring after marriage due to physical work needed and body is not ready to have sexual intercourse .

Also, it is considered a maturity comes at the age of 18 years and that’s why there are lot of things which are allowed at the age of 18 years such as suffrage, driving license etc.

So denying a girl to marry at 17 years is not denying her rights as at the age of 17 she is not that mature to take the decisions of her choice. She will not be able to understand the impact and think from all angles before taking such a decision. Although we cannot say that girl will be able to take right decision at the age of 18 years but still she will be more mature and should be able to understand things much better at this age.

Steps needed

  • Afterwards my priority will be to educate and motivate the people of the concerning community so that they give up the irrational and rudimentray traditional custom of child marriage and do not marry their girl child untill she attains at least 18 years of age.
  • For this purpose I can take help of elderly and senior people (community leaders, representatives, religious leaders etc.) of the community. If they can appreciate the idea of girls empowerment, the society itself will start to transform.
  • A widespread community camps or mobile van advertisements with the help of various NGOs can be done in this region to make people aware of the welfare schemes associated with the girls.

Conclusion

Child marriage is a sin robbing girl child of her childhood and education. It makes life more difficult and stressful leading to health issues. Such marriages are against the rights of girl children. Society must widen their horizons and encourage women’s education instead of considering girl child as a burden.
